From a legal standpoint, this is not a hemp case — it's a case about the constitutional structure of our government. After the Legislature failed to reach consensus, bureaucrats in the Executive branch anointed themselves to cherry-pick pieces of rejected bills to enforce unilaterally and practically overnight.
DSHS's new rules exceed the agency's authority and are unenforceable. My clients are registered, responsible businesses that serve a legitimate need for many Texans. DSHS's new rules take a sledgehammer to a problem that requires a scalpel.

The court will hear arguments on whether the DSHS rules should remain blocked while the full case is decided. The current TRO expires after 14 days. This hearing will also address the massive fee increases ($155 to $5,000/location retail, $258 to $10,000/facility manufacturing).
Travis County Judge Maya Guerra Gamble granted a temporary restraining order blocking the new DSHS "total THC" testing rules that effectively banned smokable hemp products statewide. The ruling also unblocked interstate sales. The court deferred the fee increase challenge to the next hearing. A temporary injunction hearing is scheduled for April 23.
The Texas Hemp Business Council, Hemp Industry & Farmers of America, and eight additional hemp companies filed suit in Travis County challenging the same DSHS regulations on identical constitutional grounds — that the agency exceeded its authority by adopting through rulemaking what the Legislature declined to pass. This parallel challenge strengthens the legal fight.
