What Happened
In late 2025, the Texas Department of State Health Services (DSHS) adopted new hemp regulations that effectively shut down legal hemp retailers across Texas — adopting pieces of bills the Legislature had explicitly declined to pass. Without proper legislative authority, DSHS unilaterally imposed restrictions that were never voted on by the Texas Legislature — and never debated by the public.
These aren't minor regulatory tweaks. They're a fundamental overreach that threatens small businesses, violates constitutional protections, and sets a dangerous precedent for government power in Texas.
Green Nation, a legal hemp retailer in Tyler, is fighting back. As a named plaintiff in a lawsuit filed by the Texas Hemp Constitutional Alliance, Green Nation is challenging DSHS's authority to create these regulations. This fight isn't just about one business—it's about protecting constitutional rights for all Texans.
